Due to the nature and objectives of the service provided, the User is required to register by providing information that may be considered personal (clinical, identification and contact details). The data collected is the exclusive property of NEUROINOVA and is intended for the operation of the COGWEB® and BRAIN ON TRACK® systems, user characterization, quality control and anonymized statistical analyses necessary to improve the performance of the aforementioned systems, and in the context of clinical research projects. All clinical data collected by the systems will be provided voluntarily and preceded by informed consent from the User. The User is responsible for all content, information and data that they register or transmit through the website, and therefore agrees to assess and assume all risks associated with its transmission. The User must register or transmit true, correct and complete information and keep it always updated. NEUROINOVA guarantees to all Users that no personally identifiable information will be provided to third parties without the prior consent of its owner, except in cases of legal obligation or court order. All services always comply with the provisions of the Personal Data Protection Law – Law No. 58/2019 of August 8.

  1. STORAGE AND SECURITY OF PERSONAL DATA PROCESSING

The processing of your data is carried out in compliance with legislation on the protection of personal data. The data is accessible to the professional responsible for cognitive training and/or cognitive monitoring through COGWEB® and/or BRAIN ON TRACK® and, with the data subject’s consent, may be communicated to other professionals or family members who accompany the user.

The processing of data depends on the authorization of its owner, through consent. The owner has the right to withdraw their consent at any time, without compromising the lawfulness of the processing carried out based on the consent previously given.

  1. DATA RETENTION PERIOD

Since cognitive training or cognitive monitoring can be interrupted and resumed whenever the user and/or professional wish, there is no time limit for data retention.

  1. Changes to the Privacy Policy

NEUROINOVA may change this Privacy Policy at any time. These changes will be published on the website www.neuroinova.com.

USE OF THE ONLINE STORE

  1. OBJECT

These general terms and conditions of sale aim to provide and define all the information necessary for the User regarding the methods of ordering, sale, payment and provision of the service, carried out on the website www.neuroinova.com. These terms and conditions govern all the necessary steps to complete the purchase and guarantee the follow-up of this service to the User.

  1. ORDER

To place an order, the user must:
a) Register on the website www.neuroinova.com, providing the requested information;

  1. b) Log in using the email and password combination chosen by the User during registration;
  2. c) Select the type of service you wish to purchase;
  3. d)Complete the information and choose the options available to you throughout the ordering process (payment method, tax identification number and name that you want to appear on the invoice for tax purposes).

NEUROINOVA will honor orders received online. In the event of unavailability of the service, NEUROINOVA undertakes to inform the User as soon as possible. The data contained in the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.

  1. PAYMENT

On the website www.neuroinova.com, NEUROINOVA offers the User the following payment methods via Easypay – Instituição de Pagamento Lda:

a) Credit card (Visa, Mastercard);
b) ÃTM reference;
c) Bank transfer.

In the case of payment by credit card, the debit will be made to the User’s card immediately after confirmation of the ability to provide the service. If any of the ordered services cannot be provided, their value will be credited to the User’s card after the order is closed.

  1. AVAILABILITY AND CONSUMPTION

The service will be made available after confirmation of payment.

  1. PRICES

Prices are in Euros, including taxes and duties, taking into account the VAT in effect on the date of payment of the order. If there is an increase in the price of any service, the User will be informed immediately and may choose to continue their order (paying the difference) or to cancel it.

  1. CANCELLATION AND REFUND

The cancellation or return process is handled on a case-by-case basis by NEUROINOVA. The request must be submitted in writing to the contact email address geral@neuroinova.com, up to 15 days after the order, with cancellation or refund instructions being provided by NEUROINOVA via the same communication channel. NEUROINOVA may consider refund requests made after the 15-day period, provided they are duly justified.

Whenever possible, the refund should be made via the same payment method. However, if this is not possible, the User must provide proof of payment and account or card ownership so that the refund can be made via bank transfer. NEUROINOVA undertakes to reimburse the User within a maximum of 15 days.

 RESPONSIBILITY

NEUROINOVA shall not be responsible for the misuse of its services, nor for any damages, losses, or harm resulting from such misuse. It shall also not be liable for any damages, losses, or harm suffered by the user or by third parties due to the use of the internet or as a result of unforeseen circumstances or force majeure.

TERMINATION

The User accepts that NEUROINOVA may suspend access to services provided on the website for various reasons, including non-payment, violation of intellectual property rights, breach of confidentiality, violation of these terms and conditions of access and use, or a decision by any administrative or judicial authority under the law, and NEUROINOVA is not responsible for the loss of access to the services provided on the website.

APPLICABLE LAW AND JURISDICTION
